Article 1: Organising Company

Renault S.A.S., a French law, simplified, joint stock company having its registered office at 13/15 quai le Gallo - 92100 Boulogne Billancourt, France, registered on the Nanterre Commercial and Companies Register under the number 780.129.987.03591, (hereinafter referred to as ‘the Organising Company’) is organising, on September 28th 2017, from 10 AM to 4 PM UTC+2, a free competition, without any obligation to purchase, entitled [#Renault40yearsF1Contest]’ that is accessible on the Renault Sport Formula One Team Twitter page, the URL of which is: https://twitter.com/RenaultSportF1

Article 2: Definitions

Phrases commencing with capitals will have the meanings attributed below or in the Rules (as defined below):

  • Registration: operation by which the Internet user who wishes to participate in the ‘#Renault40yearsF1Contest’ Competition answers the question asked on September 28th 2017 (as described in Article 3 of the Rules) associated with the Competition.
  • Competition’: The Competition the subject of the Rules, which can be entered for free with no obligation to purchase and that is accessible from the Page.
  • Participant’: a person who participates in the Competition and who is offered the prize detailed in Article 5 of the Rules.
  • Page’: the Renault Sport Formula One Team Twitter page is accessible at the URL address: https://twitter.com/RenaultSportF1 where the Competition can be accessed.
  • Rules’: the rules applicable to the Competition described in this document.

Article 3: General conditions for participation

Participation in the Competition involves express, unreserved, acceptance of all of the provisions of the Rules, the ethical rules applicable to the Internet (netiquette, good conduct charter, etc.) and the laws and regulations applicable to competitions in France.

Participation in the Competition is open to all adults (over 18) as at September 28th, 2017 residing in the following countries:

Brazil, UK, Argentina, Slovenia, Croatia, Vatican City, Vanuatu, Chad, Rwanda, Madagascar, Luxembourg, Haiti, Equatorial Guinea, Djibouti, Comoros, Central African Republic, Cameroon, Burundi, Senegal, Niger, Monaco, Mali, French Guiana, Gabon, Ivory Coast, Congo Republic, Democratic Republic of Congo, Burkina Faso, Swiss, Quebec (Canada), Benin, France, Belgium.

Persons who do not fall within the conditions referred to above cannot participate. In addition, persons who have collaborated in creating the Competition as well as Renault’s employees and Renault’s partner Agencies, members of their families (‘family’, under the Rules, means persons who live in the same household and their direct and/or collateral ascendants and descendants) cannot participate either.

In order to participate in the Competition, the Participant must:
(i) follow the Page;
(ii) be over 18 years old
(iii) give the right answer to the question asked on September 28th 2017
(iv) mention the hashtag #Renault40yearsF1 in his answer.

Once submitted, the reply stated in the tweet can no longer be changed. The Participant therefore has only one try.

After the game, two winning Participants are contacted by private message on Twitter and need to provide within 24 (twenty-four) hours the required information (ie, first name, family name, valid address and email and availabilities for the trip to Renault Sport Formula One Team facilities in Enstone) as proof of their identity.

Only the winning Participants can submit their personal information. The winning Participants undertake to send correct information and a true address to the Organising Company.

Any incorrect or incomplete registration will not be taken into account and will lead to the participation in the Competition being null and void. The same sanction will apply in the event of multiple participations by one person.

Article 4: Presentation of the free Competition without any obligation to purchase

From the Twitter page, the Participant accesses a tweet explaining the contest (9:30 AM UTC+ 2 on September 28th, 2017). Then the Competition is open at 10:00 AM UTC+2 with a question posted on the twitter account. From this moment, three (3) phases will start to run: (i) Participation, (ii) Contacting Winners, (iii), Public Confirmation of Winners by the Organising Company.

Competition rules:

The Competition consists of the Participant answering the tweet (by accompanying his answer with the hashtag #Renault40yearsF1) on @RenaultSportF1 from 10 AM to 4 PM UTC+2 on September 28th, 2017.

Once the user answers a question, his next replies will not be taken into account. At 4PM UTC+2, The data of the participants with good replies (accompanied with the hashtag #Renault40yearsF1) will be extracted and two users will be randomly picked as winners under the supervision of a Bailiff. The two Participants will be chosen as Winners after verification of their identity and availability.

Article 5: Prize

The prize will (after verification of personal details) be attributed randomly to two of the Participants (over 18 years old) who have sent the correct information and personal details requested within 24 (twenty-four) hours (hereinafter referred to as ‘the Winner(s)’).

If the Winner’s participation is found not to comply with the Rules (incorrect personal information, for example), the prize will be given randomly to another participant with correct answer (accompanied with the hashtag #Renault40yearsF1), the information and personal details of whom are correct (hereinafter referred to as ‘the Substitute Winner’).

In the event that the participation by the first Substitute Winner does not comply with the Rules, the prize will not be given out and will remain the property of the Organising Company.

The two Winners will be announced on the twitter account: https://twitter.com/RenaultSportF1 on October 2nd, 2017.

1 (one) prize is offered per Winner: [2 days trip including 1 day visit to Renault Sport Formula One Team facilities in Enstone].

This prize includes:

  • the accommodation (1 night) for a maximum value of 150 € per Winner;
  • the catering for a maximum value of 100 € per Winner;
  • the transportation for a value comprised between 100 € and 1200 € per Winner, depending on the domiciliation of this latter.

Article 6: Collecting prizes

The Winner will be contacted by the Organising Company, which will notify him that he has won the Competition by private message on Twitter. On receipt of this notification, the Winner will have a period of 24 (twenty-four) hours in which to inform the Organising Company that he has received the winner’s notification and to provide the information required by this latter by sending return message.

In the event that the Winner fails to reply within the period of 24 (twenty-four) hours, the Organising Company will attribute the prize to the Substitute Winner under the same notification and reply conditions described in the paragraph above.

If the Substituted Winner fails to reply within the given period, the prize will not be given out but will remain the property of the Organising Company.

Without prejudice to any court proceedings and its right to cancel a Participant’s registration, the Organising Company is not required to send any prize to the Winner if he has not correctly entered his personal details when registering or if he has clearly and by any means falsified the competition results or if he does not comply with the Rules.

The prize cannot be disputed, exchanged for its equivalent in cash, exchanged or replaced.

The Participant will be informed of any changes, where possible.

In the event that the prize offered is no longer available due to circumstances outside the control of the Organizing Company, the latter undertakes to offer a prize of an equivalent value.

Article 7: Advertising and promotion of the Winner

By accepting his prize, the Winner authorizes his image and personal details (first name, name) to be used in all of the Organising Company’s public communication media and at all public, promotional, events associated with the Competition, worldwide, for a maximum period of one (1) year, without such use giving rise to other rights or compensation other than the winning prize. Acceptance by the Winner of his prize does not oblige the Organising Company to publish his name.

Article 8: Right to access and rectify

In compliance with the so-called ‘Computer and Data Protection’ Law 78-17 of 6 January 1978 on computers, files and protection, any person completing the registration on the Page benefits from a right to access, rectify and delete data concerning him by contacting the Organising Company. Such rights can be exercised by sending a private message to Renault Sport F1 on Twitter.

Persons who exercise their right to delete data concerning them before the end of the Competition will be deemed to have terminated their participation.

In compliance with the current regulations, the information collected in the context of the Competition will be used exclusively by the Organizing Company and will not be sold or given to third parties in any manner whatsoever.

Article 9: Liability

The Organising Company’s liability is strictly limited to the provision of the prize actually and validly won.

The Organising Company cannot, in any circumstances, be held liable for the fraudulent use of rights of connection or attribution of a prize to a Participant. In light of the nature of the Internet, such as the unrestricted obtaining of information and the difficulty if not impossibility in controlling use that may be made of it by third parties, the Organising Company cannot be held liable for any improper use of such information.

The Organising Company cannot be liable in the event of malfunctions in the Internet, telephone lines or receiving equipment that prevents the proper functioning of the Competition. In addition, it cannot, under any circumstances, be liable for delivery problems or lost emails or letters.

The Organising Company cannot be liable in the event of any technical, equipment or software failure or anomaly of any kind (virus, bug, etc) occurring in the Participant’s computer system.

The Organising Company cannot be liable in the event of a malfunction due to human error or problem that has an electrical origin.

The Organising Company reserves the right to shorten, extend, postpone, modify or cancel the Competition if required by the circumstances. In any event, it cannot be liable for such changes.

The Organising Company will attempt to ensure that the Competition can be accessed at all times, without being bound by any related obligation. The Organising Company can at any time, in particular for any technical, updating or maintenance reasons, suspend access to the Page and the Competition contained on it. The Organising Company will not, under any circumstances, be liable for such interruptions and their consequences.

Article 10: Compliance with the rules

Participating in the ‘#Renault40yearsF1Contest’ Competition involves honest behaviour, meaning total compliance with the rules and the rights of other Participants.

Participants are prohibited from implementing or seeking to implement any participation process that does not strictly comply with the principles of the Competition and the Rules.

The Organising Company reserves the right to eliminate any person from the Competition who does not full imply with the Rules. The Organising Company also reserves the right to bring proceedings against any person who attempts to the fraud or impede the proper functioning of the Competition.

The Organising Company can decide to cancel the Competition if it clearly appears that fraud has occurred in any form whatsoever, in particular, computer fraud, in the context of participation in the Competition or the choosing of Winners.

The Organising Company reserves the right to carry out any verifications relating to compliance with this Article and all of the Rules.

Agreement on proof:

It this specifically agreed that the data contained in the Organising Company’s computer systems is proof of the details of connections and information resulting from computer processing relating to competitions organized by the Organizing Company.

Article 11: Modifications to the Rules

The Organising Company reserves the right to modify the Rules and, in particular, the Competition rules and the prizes attributed, essentially in order to take account of changes to the law, regulations or administrative regulations, or as a result of judicial decisions, recommendations issued by organizations in charge of administering the Internet and the Organizing Company’s sales policy. Each modification will be the subject of a supplementary agreement to the Rules and will be filed with the process server, as were the Rules.

Article 12: Filing of the Rules

The Rules are filed at the SCP PETEY-GUERIN-BOURGEAC, associated bailiffs, whose practice is located at 221 rue du Faubourg Saint Honoré 75008 Paris, France. The Rules can be consulted at any time on the following link: XXX throughout the duration of the Competition.

Article 13: Disputes

The Rules are governed by French law.

In the event of a dispute or claim, for any reason whatsoever, demands must be sent to the Organising Company within a maximum period of 1 (one) month after the Competition closes by way of standard letter. Such letter must state the precise date of participation in the competition, the full personal details of the Participant and the exact grounds for the dispute. No other method of dispute or claim will be accepted. The decisions by the Organizer cannot be appealed: The Organising Company only can rule on any issue relating to the application of the Rules or any omissions in it.
